New York Adoption that amends the State Uniform Fire Prevention and Building Code

On Monday, September 30, 2019, the Department of State filed a Notice of Emergency Adoption that amends the State Uniform Fire Prevention and Building Code (the “Uniform Code”) by adding provisions relating to the installation, use, and maintenance of Energy Storage Systems.

Adoption of this regulation as an emergency rule makes it effective immediately upon filing.

By filing the Notice of Emergency Adoption, the Department of State has adopted the rule on an emergency basis.

Amendments to the Uniform Code

The State Fire Prevention and Building Code Council (the “Code Council”) has adopted a rule that amends the current version of the Uniform Code, specifically 19 NYCRR Sections 1220.1, 1221.1, 1225.1, and 1227.1, by adding provisions that incorporate by reference the publication entitled 2019 Energy Storage System Supplement (Revised September 2019), publication date: September 2019. The 2019 Energy Storage System Supplement (Revised September 2019) adds provisions to the Uniform Code relating to the installation, use, and maintenance of Energy Storage Systems (ESS).

The adoption of this emergency rule became effective on the date of filing, or September 30, 2019. This rule expires November 1, 2019.
