Sussex County Delaware to adopt 2021 IBC and IRC

On May 17, 2022, The County Council unanimously approved to adopt the 2021 IBC International Building Code and the 2021 IRC International Residential Code.

Effective Date: January 1, 2023

Under Chapter 52 of the Sussex County Code:

• 2021 International Building Code – adopted Chapters 1 through 26 and Chapter 35.
• 2021 International Residential Code – adopted Chapters 1 through 10 exempting fire sprinklers for single-family homes, duplexes, and townhomes 3 stories and less in height.

Please note: all other previously adopted exemptions will no longer be valid.

All DE Registered Architect and DE Professional Engineer “SEAL” are required to be signed, dated, and include the license expiration date in a CONTRASTING color ~ No photocopies will be accepted.
